Vehicles pulling over into an unofficial (dirt) lay-by, southbound just after the roundabout and then attempting to do a u-turn on an uphill/downhill section of the A46 with bad visibility of oncoming traffic. This is a national speed limit road. This is happening because drivers are not understanding the entrance/exit to the Shell garage. I have witnessed drivers do a u-turn and then enter the garage through the exit. Today I have had to do an emergency stop to avoid a box van that pulled out in front of me, without signalling, and then fully straddled theA46 whilst attempting a u-turn. These incidents occur frequently and each member of our family has witnessed them. There will be a serious accident at some point. I feel that this could be avoided by blocking the verge and better signage for the garage., 17th June

In matters relating to Walk Lane, Irby upon Humber, North East Lincolnshire, DN37 7LA, North East Lincolnshire Council (“the Council”) have made it explicitly clear in writing that: 'As part of the Environmental Protection Act ("EPA"), we are obliged to clear mud and debris from the highway, within 24 hours of it being reported. Should this become a persistent offence, the complaint would be reported to our Highway Enforcement team for further investigation.' The same offender has once more deposited further mud, dirt and filth on the said highway at 2.40pm yesterday (14-11-2017) and yet again at 12.30pm today (15-11-2017). The Council are fully aware of the identity of this offender who also resides in Irby upon Humber, North East Lincolnshire, since the Council keep 'reminding' this individual of his 'duties' during the past few years. Section 87 of the EPA ("s87") states that it is a criminal offence for a person to drop, throw down, leave or deposit litter in a public place. Therefore the offence is immediately committed once litter, which includes detritus (Code of Practice on Litter and Refuse ("COPL&R")), has been deposited on a public highway and there are no exemptions under the EPA, for example, of permitting the offender to clear the public highway of detritus within 14 days following its deposit. Additionally, s87 does not discriminate on the grounds of the number of offences committed and/or their frequency to warrant enforcement action. Consequently, the offender is not immune from enforcement action and any further 'reminders' of their 'duties' provided to him by the Council or the Council's consideration of the 'persistent' nature of the offence would be immaterial, detrimental and discriminatory culminating from an abuse of power since other members of the public are not afforded similar 'reminders' of their 'duties' or consideration of the 'persistent' nature of any offences when committing any offence of littering under s87. I now request the Council to clear the significant accumulations of detritus from the highway within 24 hours of it being reported and restore the metalled surface of the affected areas of the public highway to Grade A, as required by the COPL&R. Furthermore, I also request the Council to investigate this further report and commence appropriate enforcement action under s87 forthwith. I also request the Council to make serious consideration of issuing a Community Protection Notice to the offender requiring his behaviour, which is having a negative impact on the local community's quality of life, to cease and ensure it is not repeated in the future.
