Dropped kerb adjacent to pay parking spaces along full length of building does not comply with code. Hight of dropped curb greater than 1 in areas and not one section within code of no greater than 5mm from top of kerb stone (where rounded stones).

Numerous potholes from junction with Redhouse court the first bend.
Potholes resultant from construction traffic during construction of new building complex, which has never been repaired. One pothole has been partially filled but still deep enough to cause damage to tyres and suspension. This has been reported previously and no actions taken to date. Finally repair or contact developer to reinstate the road to condition prior to commencing their activities on Clarkes way.

Footpath in extremely poor condition and required urgent remedial actions to resurface. Footpath not passable by residents in wheelchairs. This has been reported numerous times yet no actions taken. Please finally do something to repair the footpaths with the tax increases you claim are for potholes.

Tree just outside property
12th May
I have had to pay out for a new roof which is getting stained with sap from tree. Also to have drain and pipes cleared and relined because of roots. I don't know if roots are under my property. Also bird poo all over pathway walls and paving slabs on my property, I find this very unhygienic.

With regards to my complaints made on 10.02.25, 20.12.24, 09.12.24 and 25.11.24 copied below and other complaints made directly to the council, to which I have received no reply (complaints are supposed to be dealt with within 10 days), not only has nothing whatsoever been done to stop any of these clear severe nuisances and clear breaches of planning applications/decisions/conditions but since 1st April 2025 it has got another 1000% worse (the multiple hammering metal/concrete every minute, multiple beeping every minute, grinding/cutting, multiple banging/screeching is just totally out of control and is like living on a permanent never ending building site), with yet more new additional planning breaches including (as well as all previous breaches from a to k as below);
L) the concrete stair company are now back to manufacturing without planning permission very tall metal structures outside in the front yard with men on top of them (looking into residents properties invading privacy) being a severe noise/dust nuisance hammering the metal and grinding the metal starting every day from 6.00am/7.00am (the only manufacturing works allowed are pouring cement into concrete stair moulds in the two buildings at the back of the premises only, no metal works are allowed as stated at the planning meeting as they are a severe noise nuisance to residents, no manufacturing is allowed outside or in the metal building) - These works are in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
F additon) Another huge increase in unpermitted multiple hammering metal and concrete outside (like what you hear on a building site) being a severe noise nuisance (at least 65db-100db, only up to 35db allowed) making the floor shake and making concrete dust pollution (that got 100% worse since the unpermitted crane was installed but since 1st April 2025 has increased even further), this is now every single minute of the day ALL DAY SATURDAYS, MONDAYS TO FRIDAYS (illegal hours on Saturdays from 6.00am to 3.00pm/6.00pm, Monday-Fridays from 5.00/6.00am to 6.00pm/8.00pm). As per the planning application and the planning meeting no hammering of concrete or metal is allowed and no manufacturing is allowed outside - the only manufacturing works allowed are pouring cement into concrete stair moulds in the two buildings. These works are in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
E addition) Illegal permanent huge crane in breach of planning conditions being a severe noise nuisance (making an extremely annoying high pitched alarm/beeping noise 4,000hz even when it is not moving sometimes for hours on end, banging and clanking and extremely high pitched screeching when moving round/across the floor 70db-100db up to 35db allowed, the engine makes a humming noise), making disgusting smells of petrol pollution, it's a severe visual intrusion and an invasion of privacy. This crane was first used on 21.01.25 and has now been there for 112 days - no more than 14 days are allowed. This noise nuisance crane is being used to move things like cement buckets, metal rods and the internal metal parts of the concrete stairs that are still also being moved with noise nuisance telehandlers and forklifts and the men carrying them by hand - they are only allowed to have a temporary crane to move extremely large items on rare occasions that can't be moved with telehandlers and forklifts (they don't have planning permission to manufacture or deal with large items). It can be seen from as far away as Sundon Park. There is a man sitting in the cab of the crane that is elevated above the fence who looks into peoples houses and gardens. It is being used from the illegal hours of 6.00am/7.00am to 7.00pm/8.00pm, Saturdays 6.00am/7.00am to 2.00pm/4.00pm. They have also had on some days 2 huge cranes in use at the same time. The council confirmed in three planning applications/appeals that any crane on these premises is a statutory nuisance to the residents and therefore not allowed, as did the planning inspectorate. The original reason given for them wanting a crane was due to the noise nuisance forklifts/telehandlers which they said would be removed once the original crane was installed which did not happen so they were refused planning permission to have any further cranes, yet they are now back to having a noise nuisance illegal crane, a noise nuisance forklift and a new noise nuisance telehandler, all 3 with noise nuisance alarms all at the same time. This crane is being used in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be removed immediately. - Concrete Company
M) New bigger louder telehandler that they purchased in January 2025 being a severe noise nuisance with an extremely loud and annoying reversing alarm (the telehandler they had when they were given planning permission was using a white noise reversing alarm that we could hear but is was not as bad as the beeping, but this new alarm is so loud that is now as bad at the beeping forklift that the council confirmed as being a statutory noise nuisance), the volume of this was turned up at the end of February. It also makes a very loud banging/clanking noise when it goes over the illegal roadhumps unloaded near the fence. It is being used to move concrete and metal objects that they have no planning permission to manufacture and unloading multiple ancillary lorrys per day when only 1 ancillary lorry every 6 months is allowed. ALL DAY SATURDAYS, MONDAYS TO FRIDAYS (illegal hours on Saturdays from 6.00/7.00am to 2.00pm/6.00pm, Monday-Fridays from 5.00/6.00am to 6.00/8.00pm), as an example on Saturday they were being a severe noise nuisance with it from 6.30am and were still using it loading lorrys till past 3.00pm when the legal hours are 8.00am to 1.00pm. As per previous planning decisions the council's noise department and planning department have confirmed that the high pitched beeping of the forklifts is a statutory noise nuisance, this is louder than the beeping forklift as is therefore also a statutory noise nuisance. These are being used in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
I addition) Huge increase in noise nuisances from constant beeping, banging/thudding of multiple diggers and excavators (bucket heads banging on the floor/scraping across floor making floor vibrations and make rubbish dust and smells of rubbish) and crashing rubbish being dropped and moved ALL DAY SATURDAYS, MONDAYS TO FRIDAYS AND SOME SUNDAYS (illegal hours on Saturdays from 5.00/6.00am to 5.00/6.00pm, Monday-Fridays from 5.00/6.00am to 6.00/8.00pm, Sundays different times). When this company was given planning permission the diggers and excavators they were using had white noise reversing alarms not high pitched beepers that they have on their new ones (beepers have been confirmed by noise department as a statutory noise nuisance) and they should be changed back to white noise alarms, also the original ones also made no banging/scraping noises (they are supposed to get permission from the planning department before changing any machinery). These are being used in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Rubbish Dump
N) Cement lorrys - noise nuisances (beeping, humming noises, engine noise) and horrible smells of cement from 6-10 cement lorrys per day unloading cement outside in the front part of the premises (near houses). As per the planning application they are only allowed a total of 3 cement lorry deliveries per week delivering cement into the 2 buildings at the back of the premises between 2.00pm-4.00pm, however they are having at least 6-10 cement lorry deliveries per day (36-60 cement lorry deliveries per week when only 3 allowed), they are delivering outside in the front yard near houses as well as in the 2 buildings at the back of the premises, and are delivering from anytime as early as before 7.00am to every day past 4.00pm to as late as past 7.00pm/8.00pm. These are being used in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Rubbish Dump
O) Illegal new building/works in front of premises - In January 2025 they build a new cement drying building make out of plastic in the front of the premises near the fence opposite residential houses. Outside of this building they are manufacturing illegal concrete/metal items hammering them and grinding/cutting them outside which is where a lot of the additional noise nuisances, dust pollution, smells of cement is coming from. The planning application and decision clearly states they can only manufacture in building 1 and 2 at the back of the premises, there will be no additional building or changes to buildings, they cannot change the layout of the premises, the only manufacturing works allowed are pouring cement into concrete stair moulds in buildings 1 and 2 at the back of the premises and there will be no manufacturing anywhere else. This new illegal building and works associated with it are in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be removed immediately. - Concrete Company
O) Shouting and swearing - we can hear throughout the day men loudly shouting and swearing at each other and at residents who dare to look out of their own windows including the f and c word. This has been reported to the council previously but in the last few months it has got worse and it is disgusting that this is still continuing when there are children living in this area who should not be exposed to this disgusting language. This is being done in relation to illegal works in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
See last complaint as below for all other ongoing breaches including a) (illegal hours - Concrete Company), b) (illegal hours - Rubbish Dump), c) (noise keeping us awake all night - Rubbish Dump), g) (noise, dust, vibrations, illegal hours from illegal grinding and cutting and drilling metal and concrete including 90db+ Stihl cutters - Concrete Company), h) (noise, illegal hours from forklifts and telehandler - Concrete Company), j) (noise, vibrations, smells from generators - Concrete Company), k (All other noise nuisances, floor vibrations, rubbish dust, smells of rubbish - Rubbish Dump).
Note: the only time any of the above/below has stopped since my last complaint has been when both of the companies go quieter at the same time, as an example on 09.05.25 they was not using the noise nuisance telehandler at all until about 4.00pm when it is normally in use all day, the noise nuisance crane and diggers/excavators were turned off between about 10.15am to 11.45am, other noises also stopped between 10.15am to 11.45ama (we can only presume some type of monitoring is being done at these times, which they are both clearly aware of, as on all occasions the noise goes back to normal levels at the same time).
Attached is another photo of the illegal crane taken at illegal time of 7.23am and a photo of them illegally manufacturing very tall metal structures outside in the front yard with men on top of them hammering the metal which also show 2 cement lorrys there at the same time taken at 4.32pm (no cement lorrys are allowed after 4.00pm and only 3 cement lorrys per week)
We are sick and tired of being disturbed by these two companys 24 hours a day all day and all night including Sundays and Saturdays and it is totally unacceptable that nothing it being done to stop it and that it is being allowed to get worse. We have total loss of use of our home and garden as we can hear the noise in every room with the windows closed and don't get any sleep at night. The dust pollution and horrible smells is now so bad that I am coughing every time I breathe it in, it has also made me vomit on several occasions, I have been having sore eyes and I have been having nose bleeds. By now an enforcement notice should have been issued to stop these ongoing breaches of planning applications and conditions including breaches of working hours 24 hours a day 7 days a week, breaches of permitted works, breaches of permitted machinery, breaches of noise levels, breaches of dust pollution and vibrations and breaches of the Human Rights Act law.

With regards to my complaints made on 20.12.24, 09.12.24 and 25.11.24 copied below, to which the only response I have received is an automated email saying that my complaint has been sent to the relevant department (complaints are supposed to be dealt with within 10 days), not only has nothing whatsoever been done to stop any of these clear severe nuisances and clear breaches of planning applications/decisions/conditions but it has got 1000% worse with yet more new additional planning breaches including the concrete stair company now working 7 days a week being a nuisance (noise, dust, vibrations, visual) working manufacturing and using mobile vehicles every day at illegal hours all day Sundays from 5.00am to 6.00pm, all day Saturdays from 5.00am to 6.00pm, Monday to Friday 5.00am to 7.00pm/9.00pm when the legal hours are no working Sundays, Saturdays 8.00am to 1.00pm and Monday to Friday 8.00am to 6.00pm, including yet another new illegal permanent nuisance crane, another new unpermitted nuisance scissor lift (BEEPING ALL DAY SATURDAY AND SUNDAY), more new additional manufacturing outside grinding/hammering/cutting noises with a massive increase in concrete dust pollution (MANUFACTURING OUTSIDE ALL DAY SATURDAY AND SUNDAY), increase in noise at night now including banging gates, vehicles going in and out and machinery running all night, as follows:-
A) The concrete stair company have increased their illegal hours and are now working manufacturing outside and using mobile vehicles, scissor lifts, illegal crane 7 days a week Monday to Friday 5.00am to 7.00pm/9.00pm, Saturdays 5.00am to 6.00pm, Sundays 5.00am to 6.00pm in clear breach of the legal hours of Monday to Friday 8.00am to 6.00pm, Saturdays 8.00am to 1.00pm, no working on Sundays. This is a continued increasing clear breach of planning conditions, the BS4142 law and the Human Rights Act law and it should have been stopped by now - Concrete Company
B) The rubbish dump are still working illegal hours 24 hours a day 7 days a week keeping us awake all night long, banging gates and vehicles going in and out and machinery running all night long then from 4.30am non-stop noise already listed below including all day Saturdays from 4.30am to past 5.00/6.00pm and also on Sundays when we can hear them opening and closing the gates to let vehicles in and out and we can hear the rubbish banging and crashing when it's being unloaded and mobile vehicles moving, in clear breach of the legal hours of Monday to Friday 8.00am to 6.00pm, Saturdays 8.00am to 1.00pm, no working on Sundays. This is a clear breach of planning conditions, the BS4142 law and the Human Rights Act law and it should have been stopped by now - Rubbish Dump
C) Banging metal gates 75db-110db 2 times every 5-30 minutes all night from unpermitted hours of 7.00pm to 4.30am (and throughout Sunday), and now also vehicles going in and out of the yard through the night and throughout Sundays and machinery running keeping us awake all night every night since 24.11.24. In the last 2 weeks this has got louder and we are still getting no sleep and are tired and ill all day. This is a continued clear breach of planning conditions, the BS4142 law and the Human Rights Act law and it should have been stopped by now. - Rubbish Dump
D) A new illegal scissor lift outside making an extremely annoying high pitched alarm/beeping noise 3,900hz every second for hours on end even when it is not even moving ALL DAY SUNDAYS, SATURDAYS, MONDAYS TO FRIDAYS (illegal hours on Sundays 5.00am to 6.00pm, Saturdays 6.00am to past 6.00pm, Monday-Fridays from 6.00am to past 6.00pm) being used outside for unpermitted manufacturing outside. This is the same scissor lift that I complained about last year but since the crane was installed it has been used almost every day making this noise for hours on end outside (this scissor lift was not mentioned in the planning application or at the planning meeting). High pitched beeping has previously been confirmed by the noise department and planning department as a statutory noise nuisance. This scissor lift is being used in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be removed immediately. - Concrete Company
E) Yet another new illegal permanent huge crane in breach of planning conditions (making an extremely annoying high pitched alarm/beeping noise 4,000hz even when it is not moving sometimes for hours on end, banging and clanking 70db-100db (up to 35db allowed), the engine making a humming noise. This crane was first used on 21.01.25, currently 21 days - no more than 14 days are allowed. F) Unpermitted multiple hammering metal and concrete outside at least 70db-100db (up to 35db allowed) making the floor shake and making concrete dust pollution (that has got 100% worse since the unpermitted crane was installed), ALL DAY SATURDAYS, SUNDAYS, MONDAYS TO FRIDAYS (illegal hours on Saturdays from 6.00am to 6.00pm, on Sundays randomly from 6.00am, Monday-Fridays from 5.00/6.00am). As per the planning application and the planning meeting no hammering of concrete or metal is allowed and no manufacturing is allowed outside - the only manufacturing works allowed are pouring cement into concrete stair moulds in the two buildings. These works are in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
G) Unpermitted grinding and cutting and drilling metal and concrete including 90db+ Stihl cutters all outside at least 65db-110db (TODAY PERSISTENTLY 80DB-110D) (up to 35db allowed) up to 10,000hz making the floor shake and making concrete dust pollution (that has got 100% worse since the unpermitted crane was installed), ALL DAY SATURDAYS, SUNDAYS, MONDAYS TO FRIDAYS (illegal hours on Saturday from 6.00am to 6.00pm, on Sundays randomly from 6.00am, Monday-Fridays from 5.00/6.00am). As per the planning application and the planning meeting no grinding or cutting or drilling or any tools on concrete or metal is allowed and no manufacturing is allowed outside - the only manufacturing works allowed are pouring cement into concrete stair moulds in the two buildings. These works are in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
H) Forklifts beeping/banging and telehandler banging/white noise reversing alarm noise (the volume of this has been turned up in the last 2 weeks) ALL DAY SATURDAYS, MONDAYS TO FRIDAYS (illegal hours on Saturdays from 6.00/7.00am to 6.00pm, Monday-Fridays from 5.00/6.00am to 6.00/8.00pm). As per previous planning decisions the council's noise department and planning department have confirmed that the high pitched beeping of the forklifts is a statutory noise nuisance. These are being used in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Concrete Company

J) Generator noise making floor vibrations and smells of petrol being used for power unpermitted power tools (illegal hours on Saturdays from 6.00/7.00am to 6.00pm, Monday-Fridays from 5.00/6.00am to 6.00/8.00pm different times, Sundays from 5.00am-6.00pm different times). As per the planning application and the planning meeting no power tools/machinery or manufacturing is allowed outside - the only manufacturing works allowed are pouring cement into concrete stair moulds in the two buildings. This machine is in clear breach of planning conditions, noise/dust laws and the Human Rights Act law and should be stopped immediately. - Concrete Company
K) All other noise nuisances, floor vibrations, rubbish dust, smells of rubbish, from the rubbish dump from the unpermitted hours of 4.30am to past the unpermitted hours of 2.00pm including as listed previously below, beeping/banging skip lorrys, banging/crashing rubbish, crusher machinery, etc., is still the same. When this company was given planning permission the 4 skip lorrys moving 40 times per day that they had permission for (they now have about 50-100 different lorrys moving 100-200 times each day) were using white noise reversing alarms not high pitched beepers that they have on their new current ones (their own noise assessment proved that the noise from the beepers and banging and loading and moving lorrys is 3-4 times more than the permitted noise level) and they should be changed back to white noise alarms (they are supposed to get permission from the planning department before changing any lorrys). These are being used in clear breach of planning conditions, noise laws and the Human Rights Act law and should be stopped immediately. - Rubbish Dump
It is truly disgusting that the concrete stair company is now working and disturbing residents all day on Sundays and Saturdays when the councillors at the planning meeting said that the noise nuisances and concrete dust from these premises is unacceptable near residential houses and making residents lives hell and the councillors said to the planning department that if they worked outside of the hours of Monday-Friday 8.00am to 6.00pm, Saturday 8.00am to 1.00pm and no working on Sundays then the council must get it stopped, but they have worked every day outside of the legal hours and all complaints are ignored.
We are sick and tired of being disturbed by these two companys 24 hours a day all day and all night including Sundays and Saturdays and we now have total loss of use our home and garden as we can hear the noise in every room with the windows closed and don't get any sleep at night. By now an enforcement notice should have been issued to stop these ongoing breaches of planning applications and conditions including breach of working hours 24 hours a day 7 days a week, breaches of permitted works, breaches of permitted machinery, breaches of noise levels, breaches of dust pollution and vibrations and breached of the Human Rights Act law.
As this is something that has been getting worse for years and nothing is being done to stop it or to stop the planning breaches, if this is not stopped within the next 48 hours then we are going to be left with no option but to take further action including going to the press/media with residents videos and photographic evidence.
MY COMPLAINT SENT ON 20.12.24:-
With regards to my complaints made on 09.12.24 and 25.11.24 copied below, to which the only response I have received is an automated email saying that my complaint has been sent to the relevant department (complaints are supposed to be dealt with within 10 days), when is something going to be done to stop the street nuisance banging of metal gates 74db-100db through the night at illegal hours 6.00pm to 4.00am (which gets more persistent from 10.00pm/11.00pm) at the rubbish dump at 250 Toddington Road, Luton, Bedfordshire, LU4 9DZ, keeping us awake all night making us ill that has now been going on every night from 24.11.24 for almost 4 weeks and the other nuisances from illegal times of 4.00am. Since my complaint on 25.11.24 the noise in the daytime has been the same except on a couple of occasions for about 1-2 hours when both of the companies went quieter (we can only presume some type of monitoring was being done, which they were both clearly aware of, as on all occasions the noise was back to normal levels at the same time).
By now an enforcement notice should have been issued for these ongoing publicly advertised breaches of hours and a noise abatement should have been issued for the already proven illegal noise levels both that the council have known about since January 2022, so can you please confirm that this has been done and confirm when this is going to be stopped. As stated below it clearly shows on their google/facebook page they are open and illegally accepting rubbish vehicles from the general public (only their own four skip vehicles are allowed) from 6.30am Monday-Saturday and are using their own skips/lorrys/machinery being a statutory nuisance as below from 4.00am when the legal hours are from 8.00am and when a planning application in 2010 to change the hours to 6.00am was refused by the council due to the noise nuisances from the skips/lorrys. Also as stated below in 2015 their own noise assessment proved that the noise levels from their then rubbish skip lorrys (the ones now are even louder) heard from the residents side of the road are a statutory noise nuisance including reverse beeping 74db and loading/unloading empty skips 85db when the council web site clearly states that residents should not hear noise above 30db-35db.
I really hope that we will not be having to listen to this all night and all day during the entire Christmas and New Year holiday period as we have had to for the last 2 years (when they were given planning permission for retrospective works they were closed every year over this entire holiday period but for the last 2 years have worked every day over this holiday disturbing residents when it should be our one week of peace and quiet) as we have people coming to our house and we do not want them to be kept awake all night and not have to listen to the illegal noise nuisances and not feel the house shaking all day and night and not breathing in dust or smelling the disgusting smell of rotten rubbish.
MY COMPLAINT SENT ON 09.12.24:-
With regards to my complaint made on 25.11.24 regarding the extremely serious street nuisances at illegal workings hours including noise nuisances and floor vibrations and dust/smell pollution 24 hours all day and keeping us awake all night from the illegal rubbish dump/scrap metal yard to the general public and concrete stair/illegal metal works company both at 250 Toddington Road, Luton, Bedfordshire, LU4 9DZ, which I have copied below, we are extremely angry that not only has nothing been done to stop any of this but it is now louder and more often through the night, i.e. as at the date of my last complaint they were banging the metal gates 2 times every 15-30 minutes but a few days after my complaint it increased to at least 2 times every 2-20 minutes. As an example yesterday on a Sunday this banging gates (which has now increased to at least 74db-100db) was from 4.00pm to 4.00am (12 hours all night long) an average of 10-14 times every 4-11 minutes per hour, which was about 120-170 times all night, an example below is of the number of times the gates were banged between 11.00pm-midnight):-
11.00pm, 11.01pm, 11.05pm, 11.08pm, 11.12pm, 11.13pm, 11.24pm, 11.25pm, 11.36pm, 11.37pm, 11.45pm, 11.46pm, 11.54pm, 11.58pm
These constant nuisances at illegal working hours as listed above and below, keeping us awake all night, are making us ill and constantly tired and severely depressed. As it clearly shows on this companys google page and social media pages that they are open and illegally accepting rubbish vehicle from the general public (only their own four skip vehicles are allowed) from 6.30am Monday-Saturday (they are actually working and being a statutory nuisance as below from 4.00am) when the permitted hours are Monday-Friday 8.00am-6.00pm, Saturday 8.00am-1.00pm (in 2010 the council refused a planning application - 10/00665/VARCON - to change the hours to Monday to Friday 6.00am to 6.00pm and Saturdays 8.00am to 6.00pm as the council rightly stated that this would be a noise nuisance to the local residents), then there is absolutely no reason whatsoever why these illegal hours have still not been stopped.
All of the other nuisances in my complaint from 25.11.24 (copy below) are still going on all day long from illegal hours 4.00am-8.00pm/10.00pm and some have in fact increased as follows:-
More new additional high pitched beeping mobile vehicles/lorrys on top of the multiple ones both companys already had.
(addition to B in last complaint) - The non-stop banging/thudding every second of multiple diggers and excavators (bucket heads banging on the floor/scraping across floor making floor vibrations) has got louder and the floor vibrations are worse, all of the other nuisances in (B) below (beeping, humming, jackhammer noises, dust, vibrations, etc.) are the same and are still non-stop from 5.00am/6.00am.
(addition to G in last complaint) - The concrete stair company (who are also doing illegal metal works) illegal grinding and cutting and hammering metal and concrete has got worse with now even more machinery in use (whilst I have been writing this they have been non-stop cutting metal with a 100db Stihl cutter outside up by the fence right near residential houses, multiple cutting and grinding metal and concrete outside and also in buildings with open doors, multiple hammering and chiselling metal and concrete outside and also in buildings with open doors since 6.00am), despite no manufacturing with power tools allowed and no metal works allowed. All other nuisances from this company from illegal hours 5.00am-8.00pm/10.00pm (permitted hours are 8.00pm-6.00pm) which include banging metal, beeping/banging forklifts/telehandlers, banging moving/loading lorrys, multiple generators, other machinery are the same as below.
All other complaints including illegal working hours listed in the previous complaint below are exactly the same.
The noise nuisances are so loud they can be heard in every room of the house and you can actually feel the vibrations of the noise nuisances through the floors and walls. We can't get any peace and quiet in any room of our house. I have tried to block out the banging through the night by sleeping wearing ear plugs and ear phones (with music blaring out of them) but the banging is so loud I can still clearly hear it. All of these noise nuisances can be clearly heard from residents front and back gardens and also from the road, it can be clearly heard from the street path near the main receptors of noise homes.
The volume of all of these recorded from inside a residential property is persistently 60db-100db (the council recorded it at this volume from inside a residential property several years ago and confirmed it at that time as being statutory noise nuisances but it has continued to increase, especially from the rubbish dump since 2022), the banging gates at night 74db-100db and the normal background noise when they are not working is about 30db-45db. The council web site clearly states that:-
(1) the permitted noise levels that residents should hear from industrial works are 15db less than the normal background noise level so the noise that we hear from these premises should be no more than 30db (45db less 15db = 30db), yet the noise is 60db-100db (15DB-55DB HIGHER, THAN THE PERMITTED NOISE LIMIT).
(2) the permitted noise levels that residents should hear from commercial works 7.00am-11.00pm are in the living room 40db, outside 55db (no mention of bedrooms where the noise hear is even louder), yet the noise is 60db-100db inside and 70db-110db outside (INSIDE 20DB-60DB HIGHER AND OUTSIDE 15DB-55DB HIGHER THAN THE PERMITTED NOISE LIMIT)
(3) the permitted noise levels that residents should hear from commercial works 11.00pm-7.00am (they don't have planning permission to work these hours) are in bedrooms 30db, yet the noise is 60db-100db and the banging gates 74db-100db (30DB-70DB HIGHER THAN THE PERMITTED NOISE LIMIT, BANGING GATES 44DB-70DB HIGHER).
So again, please get these illegal hours stopped immediately as per planning conditions, as well as stopping all of the other continuing to increase statutory nuisances, that are making us ill, tired and severely depressed.
MY COMPLAINT SENT ON 25.11.24:-
We are sick and tired of being kept awake all night (last night I did not get any sleep at all) by the illegal rubbish dump/scrap metal yard to the general public (they only have planning permission for a skip hire company) extremely loud (70db-100db) banging/clattering of metal gates opening and closing and scraping/dragging the metal gates across the floor making the floor/house shake every 15-30 minutes all night from 7.00pm to 4.00am (illegal working hours) and then non-stop every second noise nuisances 60db-100db (only 30db allowed), floor vibrations, dust pollution and disgusting rotten rubbish smells usually from about 4.00am (illegal working hours) onwards including; (A) at least 200 rubbish skip lorrys/member of public vehicles movements beeping/humming/banging (the company are only allowed 4 8 ton rubbish skip lorrys using white noise reversing alarms with no more than 24 movements allowed per day from 8.00am to 6.00pm/1.00pm Saturdays and no member of public vehicles are allowed but they have 200+ vehicles per day an average of 20-40 of their own multiple sized rubbish skip lorrys using high pitched beepers and multiple member of public vehicles per hour from 4.00am to some days as late as 9.00pm including Saturdays and some Sundays), (B) non-stop multiple diggers and excavators high pitched beeping and humming and banging (bucket heads banging on the floor/scraping across floor making floor vibrations) and crashing rubbish from heights and new ones purchased May 2024 that sound like jackhammers all every second from 5.00am/6.00am (they were given permission to have only 2 small ones using white noise reversing alarms but they now have multiple ones of different sizes high pitched beeping, banging, etc., all day), (C) banging/crashing rubbish/metal non-stop from 4.00am, (D) humming crusher machines making vibrations and dust pollution from 5.00am/6.00am (they were given permission to use the yellow crushing machinery at the back of the premises that crushed rubbish undercover but these new ones are releasing dust into the air, (E) rubbish dust pollution and (F) disgusting smells of rotten rubbish (both from crusher machinery and rubbish skip lorrys), (G) also the concrete stair company next doors non-stop beeping/banging forklifts (they now have 3 of these) and banging telehandlers and banging and grinding and cutting and hammering metal and concrete (no manufacturing with power tools allowed and no metal works allowed). The volume of all of these recorded from inside a residential property is persistently 60db-100db when the permitted noise levels as stated on the council web site are 30db-35db, which is more than double the permitted level.
The permitted hours are for the back premises Monday to Friday 8.00am to 6.00pm (machinery 10.00am to 4.00pm at 30 minute intervals on/off), Saturday 8.00am to 1.00pm (no use of machinery), no working Sundays/Bank Holidays and the front premises Monday to Friday 8.00am to 5.00pm, no working Saturdays or Sundays (they do not have planning permission to use the front premises as the front premises only has permission for storage/distribution of drainage materials using mobile vehicles and lorrys with white noise reversing alarms). In 2010 Luton Borough Council refused a planning application from these premises requesting to change the hours to Monday to Friday 6.00am to 6.00pm and Saturdays 8.00am to 6.00pm as the council rightly stated that this would be a noise nuisance to the local residents.
Also in 2015 it was proved in their own noise assessment that the noises from their then rubbish skip lorrys (the ones they have now are even louder) heard from the residents side of the road are a statutory noise nuisance which were Reverse Beeping 74db, air brakes 85db, moving 67db, Loading/unloading empty skips 85db (no readings were taken of full skips and no skip sizes were stated). The council web site clearly states that residents should not hear noise above 30db-35db but this proved it was 67db to 85db and that this was classed as a statutory noise nuisance, the many more different sized rubbish skip lorrys they have now are much louder than this.
The council have previously confirmed in writing that the high pitched beepers are statutory noise nuisances and have even stated this in several planning applications 2 of which were refused due to the ongoing noise nuisances including the beeping that the noise department confirmed they had witnessed from residential properties many times.
This has now been reported (including multiple videos, audios and photos) directly to the council by many residents on many occasions and is in clear breach of their planning conditions including breach of permitted working hours and in clear breach of the permitted noise levels and the human rights act law right to a peaceful use of our home and premises.
Please get these illegal hours stopped immediately as per planning conditions, as well as stopping all of the other continuing to increase statutory nuisances.

Overfilled and unemptied council bin

Halfway down the alleyway from Poynters Rd to Bracknell Close there is a black, permanent council bin where I assume passers-by can get rid of minimal items. Unfortunately this has been overfilled with some bags and has not been emptied in several weeks. Foxes seem to have got at it and now the rubbish is all along the pathway and is starting to smell (and flies are gathering). This is particularly disgusting for myself and my 4 year old son who take this route daily. There are also lots of schoolchildren who use this path
